Clients who are charged with a DWI will contact me and ask me if they’re going to have to have an ignition interlock device installed on their vehicle. An ignition interlock device is a device that’s installed on your vehicle, on the steering column, which requires you to blow into before you can start the vehicle. This device is monitored generally by the Department of Probation who will determine whether or not there’s been any violations where you have alcohol on your breath on the time you’re operating a vehicle.
It is a requirement that those convicted of DWI in New York now have an ignition interlock device for up to a year. There may be certain exceptions to this rule. If you don’t own a vehicle or operate a vehicle in New York State, then you will not be required to have an ignition interlock device installed. You will have to understand that, for a period of one year, you won’t be able to operate a vehicle in New York State, unless that vehicle has been equipped with an ignition interlock device.
