What are the Differences Between a Contested and Uncontested Divorce?

My clients often ask me: what is an uncontested divorce? How will this affect my divorce? Essentially, an uncontested divorce allows the two parties who are seeking a divorce to determine the terms of their divorce. Essentially, it determines two things. One is their marital assets and their liabilities. It gives the parties the right to determine how they’re going to divide the marital pop.

The second is the custody in regards to their children. Who will have physical custody and who will have legal custody over the children? It is very important that when you are served with divorce papers and are considered an uncontested divorce for you to meet with an attorney as soon as possible.
