Failure to Register
If you have recently been convicted a sex crime and have been ordered to register as a sex offender by the court, you must do so within the allotted amount of time or face additional problems with the court. If the defendant refuses to register, they may be ordered to return to court and face revocation of their probation or parole privileges as well as additional court sanctions and possibly having to serve time.
Our experienced team of New York criminal attorneys can help you understand your situation to make sure you know what is happening in court to know if you are required to register or not following the completion of court conferences. We have helped our clients negotiate probation sentences that interfered as little as possible with normal day to day life as well as assisted them with understanding the process of registering to make sure they complied with all the courts demands.
Please see our article on SORA and the differing levels to understand which level might be assigned following your conviction. If you have already been assigned a level, there may still be options for you as well. In the past, we have helped our clients with appeals to their registration levels.
However, if the defendant refuses to register appropriately in the ordered amount of time, a secondary statute has been put in place to allow the court to penalize those who do not comply. This statute orders that anyone who does not comply is guilty of a class E felony for their first offence. It becomes a class D felony for their second or subsequent offense. This can mean time behind bars for those were not already ordered to do so and can further disrupt life. In conjunction with this, anyone who is ordered to register cannot operate, dispense goods for retail sale or be employed on such a vehicle that is engaged in the retail sale of frozen desserts.
