Sex crimes in New York have specific legal definitions. Consent and Lack of Consent have specific definitions as do many other legal terms. In addition to consent many other variables may affect a sex crime including the physical condition of the alleged victim and whether the victim was intoxicated. The mental capacity of the victim and the age of the victim may also be substantial factors. Even the age of the accused may be a factor.
The evidence in Rape cases may consist of eyewitness testimony, forensic and DNA evidence, medical testimony and statements made by the accused, either to the police or the victim or others. Often, the prosecutor my try to use an “outcry witness” who is the first person that the victim told.

Registration as a sex offender can be very burdensome and generally lasts a minimum of 20 years and usually longer. Level 2 and level 3 sex offenders in New York are on the internet with their pictures and crimes making it difficult to find housing and work.
