Class A Felonies in New York

Class A felonies are the most severe category of crimes under the New York Penal Law. They represent the most egregious criminal behavior, often involving extreme violence, significant harm to individuals or society, or large-scale drug trafficking. Class A felonies are split into two subcategories: Class A-I and Class A-II and are further split by whether they are classified as violent or non-violent.  While rare compared to lower classes, a conviction for a Class A felony almost always results in extended prison sentences, frequently involving life imprisonment.

Violent vs. Non-Violent Class A Felonies

Violent Class A felonies include crimes that result in death, grave bodily harm, or pose an immediate threat to public safety. For example, Murder in the First Degree is a Class A-I violent felony and is considered one of the most serious charges one can face. Aggravated murder, terrorism, and kidnapping in the first degree also fall into this category.

Non-violent Class A felonies, while not involving direct physical harm, typically concern drug trafficking or enterprise corruption. Operating as a major drug trafficker, under Penal Law § 220.77, is a non-violent Class A-I felony. Although labeled “non-violent,” these crimes are treated with the utmost seriousness due to their wide-reaching societal impact.

Sentencing Guidelines for Class A Felonies

Class A-I felonies carry mandatory minimum sentences, often without the possibility of parole. For instance:

  • Murder in the First Degree: Punishable by life imprisonment without the possibility of parole.
  • Other Class A-I Felonies: Typically sentenced to 15 to 25 years to life.

Class A-II felonies, such as major drug offenses, carry indeterminate sentences ranging from 3 to 8 years to life. Sentencing can vary based on prior convictions, the presence of mitigating circumstances, and plea agreements.

  • Aggravated Murder (PL § 125.26)
