DWI Penalties for CDL Drivers
According to New York law, the BAC limit for CDL drivers is .04%, as opposed to .08% for regular drivers. This means that it may be illegal for you to drive with just one or two drinks in you. In addition, when you are a CDL driver, you automatically provide consent to be tested by police officers for alcohol or drugs through a blood or breathalyzer test.
In general, the penalties for CDL drivers are much harsher than ordinary license holders. You should retain a DWI lawyer in the Bronx, Westchester, Manhattan or the surrounding areas to fight these penalties.
If a CDL driver is convicted of their first DWI offense, they may have their driving privileges revoked for one year in addition to criminal penalties faced by regular drivers. That revocation is twice the length of a revocation for non-CDL drivers. However, if you are a CDL driver transporting hazardous materials and your BAC is over the limit, you license will be revoked for a minimum of three years. If a CDL is driver is convicted of their second DWI offense, there driving privileges are permanently revoked, along with a possible prison sentence and fines.
